Biography
Doug is a Partner at BraunHagey & Borden. He represents plaintiffs and defendants in high-stakes commercial disputes, including trade secret, employee mobility, fiduciary duty, contract, fraud, and intellectual property matters. With substantial jury and arbitration trial experience, Doug has won cases and motions across the country, adeptly distilling complex technical subject matter into compelling and accessible presentations. He also helps clients proactively minimize risk by advising on employment issues, intellectual property strategies, regulatory interpretation, and corporate governance.
Before joining BHB, Doug was a partner at a San Francisco litigation boutique recognized by Chambers for its achievements in trade secret and IP litigation. He has also served as the in-house head of litigation, regulatory, and government relations at a Silicon Valley company, and understands firsthand how legal needs must fit into overall business goals. Doug prides himself on executing targeted, efficient litigation strategies that generate superior results without breaking budgets or undermining business performance.

Doug second-chaired a one-week jury trial before Senior Judge Illston of the Northern District of California, representing Plaintiff Eventbrite against Canada’s largest independent concert promoter and organizer in one of the first cases to construe the meaning of the term “material adverse change” under California law. The jury deliberated for less than two hours, returned an $11 million award in Eventbrite’s favor, and rejected all of Defendant’s counterclaims.

After a one-week trial, Doug and his team secured an award entering only nominal damages against employee who retained technical and other materials relating to semiconductor fabrication technology after departing one international company for its competitor.

Together with the National Police Accountability Project and Disability Law United, Doug is helping Elisa Daher hold Sacramento County responsible for shooting and killing her husband within seconds of arriving on scene, while he was in the throes of a mental health crisis. This slaying is part of a larger, well-documented pattern of unnecessary and disproportionate violence against mentally ill persons in Sacramento and across the country. Doug and his team are pursuing injunctive and other relief to protect some of Sacramento’s most vulnerable community members.

Doug has also served as trial counsel to Instacart in its successful defense against contract and fraud claims brought by a former senior executive over the issuance of restricted stock units; secured favorable negotiated resolutions on behalf of multiple sets of founders accused of stealing trade secrets from former employees; secured emergency relief on behalf of employer against employee who stole sensitive company materials on their way out the door; helped hundreds of employees successfully transition from one competitor for another in compliance with non-competition and other covenants.

When he’s not advocating for his clients, Doug can be found enjoying the outdoors with his wife, spoiling their children, listening to bad fiction, and eating too much hot sauce.
