Biography
Kevin Wallace is a Partner in BraunHagey & Borden’s New York office. Kevin is a first-chair trial lawyer and a former Senior Enforcement Counsel at the Office of the New York Attorney General. In that role, he handled many of the most complex, high-profile investigations and trials brought by the Attorney General and led the Office’s securities enforcement unit and the Investor Protection Bureau. Kevin also led bipartisan, multi-state litigation in federal court, and worked closely with federal regulators, including the DOJ, SEC, and FTC.
Kevin’s practice covers complex litigation and enforcement matters across a range of fields including securities, corporate governance, antitrust, consumer protection, business fraud, intellectual property, and class actions. Over the course of his career, Kevin has dedicated significant time to pro bono matters, including winning the reversal of a death penalty sentence at the Sixth Circuit.

Kevin represents Barnard College, through the College Board of Managers of the Cathedral Gardens Condominium, in construction-defect litigation against the building’s sponsor and its affiliated general contractor. The Upper Manhattan building, which houses Barnard faculty and students alongside a residential condominium, has pervasive code violations and departures from its plans and specifications. With millions of dollars in damages at stake, Kevin has driven the case to trial, scheduled for the fall of 2026.

Kevin represented a long-standing firm client, an environmental and engineering consulting firm, in protecting a trademark it had acquired with two decades of goodwill after a newly formed competitor adopted a confusingly similar name. Kevin sent a cease-and-desist letter with a draft complaint, and within days the competitor agreed to change its name and branding. The matter was resolved confidentially without litigation.

Kevin represented the Special Committee of the Board of Directors of Imperial Holdings, Inc., an NYSE-listed specialty finance company, after federal agents executed a search warrant at its headquarters in connection with a U.S. Attorney’s Office investigation of its life insurance premium finance business. The committee, composed of all of the company’s independent directors, conducted an independent investigation. The company resolved the federal investigation through a non-prosecution agreement in which the U.S. Attorney’s Office credited the company’s self-investigation and cooperation.*

As part of Winston & Strawn’s pro bono team, Kevin briefed the Sixth Circuit appeal of Andrew Thomas, who had been on Tennessee’s death row since 2001. The team uncovered that the FBI had paid the prosecution’s key witness $750, a payment never disclosed to the defense and denied by the witness on the stand. The Sixth Circuit held that the nondisclosure violated Brady v. Maryland and vacated Thomas’s conviction and death sentence. In 2019, the State agreed to a plea under which Thomas received a 25-year sentence.*

Before joining BHB, Kevin led some of the most significant enforcement actions brought by the New York Attorney General's Office. He served as lead counsel for New York in California v. Meta Platforms, Inc., part of a multistate coalition of attorneys general suing Meta in consolidated multidistrict litigation in the Northern District of California for violating the Children's Online Privacy Protection Act and state consumer protection laws through platform features designed to hook young users. In August 2026, the coalition announced a settlement under which Meta will pay up to $17.1 billion and adopt new protections for young users. Kevin was lead counsel in People v. TikTok, a state consumer protection and fraud action seeking to hold the platform accountable for the harm its addictive design causes teenagers; in 2025, the court denied TikTok’s motion to dismiss. He also served as lead counsel in People v. Donald J. Trump, directing both the investigation and the trial of claims that Donald J. Trump and his associates engaged in a persistent, decade-long scheme to inflate the value of his assets on his annual financial statements in order to secure favorable loans, insurance coverage, and tax benefits. Kevin was the lead state lawyer examining Trump on deposition and when he took the witness stand, during the New York civil fraud trial. Media outlets have called him a "stealth David" taking on Goliaths.
